1. Norman C. Heckler & Company has made every attempt to describe correctly the property being sold in this catalog. Descriptions are guaranteed to be accurate as regards authenticity, age, condition, and measurements, as represented in this catalog or at the time of the sale. Measurements are guaranteed to be accurate to within one-fourth inch.
Any item listed in the catalog or otherwise identified by the Auctioneer as having any form of damage is sold strictly "as is" and may not be returned. In describing damage, exterior wear or manufacturers flaws that, in our opinion, do not significantly detract visually or monetarily from the value of the item are not listed and will not be considered for refund.
The Auctioneers reserve the right to make verbal corrections and provide additional information from the block at the time of the sale.
Absentee bids will not be executed on items which are found to be other than described in the catalog.
2. The Auctioneer has the right to reject any bid and to advance the bidding at his absolute discretion; if he determines that any opening bid is not commensurate with the value of the article offered, he may reject the bid and withdraw the article from sale, and if, having acknowledged an opening bid, he decides that any advance thereafter is not of sufficient amount, he may reject the advance. The highest bidder acknowledged by the Auctioneer shall be the purchaser. In the case of a disputed bid, the Auctioneer shall have the sole discretion in determining the purchaser or may offer the article for resale. Should there be any dispute after the sale, the Auctioneers record of the final sale shall be conclusive and binding.
3. Some lots in this sale may be offered subject to a reserve. The reserve is a confidential minimum price agreed upon by the consignor and Norman C. Heckler & Co. below which the lot will not be sold. In no case will the reserve exceed the estimates listed. A representative of Norman C. Heckler & Co. will execute such reserves by bidding for the consignor.
4. A PREMIUM OF 10% WILL BE APPLIED TO ALL PROPERTY SOLD, TO BE PAID BY THE BUYER AS PART OF THE PURCHASE PRICE. The purchasers account shall include this premium in addition to the amounts bid and any applicable sales tax, and shipping and handling charges. Full payment of each purchasers account must be received on the date of purchase (or, for absentee bidders, immediately upon receipt of a bill for payment.) Payment will be made by cash or certified check, unless other specific arrangements have been made at least two days prior to the auction. Personal checks will be acceptable only if credit has been established with the Auctioneers or if the Auctioneers have received a bank authorization guaranteeing a personal check. The Auctioneers reserve the right to hold merchandise purchased by personal check until the check has cleared the bank.
Items remaining unpaid 30 days after billing may be resold to the under bidder or at a subsequent sale at the discretion of the Auctioneers.
5. At the fall of the auctioneers hammer the Buyer shall assume full risk and responsibility for the Lot. All purchases must be paid for and removed from the premises immediately after each session of the sale unless prior arrangements to hold them have been made with the Auctioneers.
6. We will ship and insure all items bought by absentee bid, and other purchases for which shipment is requested, via U.P.S. except those lots exempted by size or quantity. The purchaser agrees that all such packaging, handling and shipping is at the sole risk of the purchaser and that Norman C. Heckler & Co. shall have no liability for any loss or damage to such items, and the purchaser shall pay for the purchase in advance, plus all packaging expenses, including labor, materials, postage and carrier fees, and all insurance charges. Absentee purchases will be shipped only after full payment has been received. All items will be shipped via UPS. Our charges for shipping (excluding foreign shipments) are $10.00 for the first item , $8.00 for each additional item together with extra insurance costs ($0.35 per $100.00). Allow four to six weeks for delivery.
7. All purchases are subject to state sales tax unless the purchaser presents a state sales tax exemption number; or, the articles are shipped out of state; or, the purchaser is a resident of another state who presents a copy of a valid tax exemption permit together with a copy of a recent advertisement or other documentation indicating status as a dealer in antiques.
8. Refunds will be given at the discretion of the Auctioneers and request for refunds for items purchased in person at the gallery must be made before those items leave the gallery. Items purchased by absentee bid must be examined and request for refund made immediately upon receipt of the item or items. Since opinions can differ, particularly in the matter of condition, the Auctioneers will be the sole judge in consideration of refunds. Refunds requested on the grounds of authenticity must be made within 15 days of the date of auction, and such refund requests must be accompanied by at least one supporting statement in writing from an authority recognized by the Auctioneers. It is the Auctioneers sincere intention to consider any reasonable request for a refund.
9. Bidding on any item indicates your acceptance of these terms and all other terms announced at the time of sale.
